The Petitioner apprehends his arrest in Hawai Adda P.S. Case No. 55 of 2016 registered for the offences punishable under Sections 418, 420, 464, 468, 469 and 120B of the Indian Penal Code.
The Informant alleged that the petitioner and one Sunny Kumar were working with him and they used to maintain his account work. During the course of working the Informant disclosed the password of the computer to the petitioner and Sunny Kumar and they provided some benefits to the dealers Raghwendra Sharma, Amit Sharma and Vivek Kumar.
It is submitted that petitioner was not knowing the password of the Informant. The password of Comfed was with
Patna High Court Cr.Misc. No.23278 of 2016 (3) dt.28-07-2016 the Informant. Nobody has seen the petitioner making any debit and credit in the account of some of the dealers. No loss has been caused to the Comfed. The credit does not confer any right on the dealers and the same account can be verified and corrected. The petitioner did not get any benefit from the wrong entries in the accounts of dealers.
Considering the facts aforesaid, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sushree Sabita Rani, Judicial Magistrate, 1st Class, Patna or her successor in connection with Hawai Adda P.S. Case No. 55 of 2016 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
