JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being father-in-law of the deceased is languishing in jail custody since 21.02.2015 in a case initially registered under section 302/34 of the Indian Penal Code but subsequently, after completion of investigation police submitted charge sheet under section 304B/34 of the Indian Penal Code. The marriage of deceased had taken place near about four years ago and after marriage she gave birth to four children. In course of investigation, witnesses stated that petitioner used to quarrel with the deceased and on the alleged date of occurrence a quarrel took place between the petitioner and deceased as a result of which deceased consumed poison.

No.41231 of 2015 (4) dt.17-12-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Supaul P.S.Case No. 152 of 2014.
