The petitioner seeks bail in a case registered for the offences punishable under sections 363 and 366-A of the Indian Penal Code and section 3(1)(x) of S.C./S.T. (Prevention of Atrocities) Act.
The informant stated that his minor daughter was missing from the night of 27.03.2015. Suraj Sharma and his father enticed his daughter. Informant further alleged that Suraj Sharma confined the daughter of the informant.
It is submitted that petitioner is father of Suraj Sharma and he has no concern with his son. He is alleged to have fled away with the daughter of the informant.
Patna High Court Cr.Misc. No.43093 of 2015 (2) dt.18-09-2015 On the other hand learned counsel for the informant as well as learned Additional Public Prosecutor submitted that the petitioner was also instrumental in kidnapping the minor daughter of the informant.
Considering the fact that the petitioner is father of Suraj Sharma and he is in jail since 01.07.2015, petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Mufassil (Banuchhapar) P.S.
