The petitioner seeks regular bail in connection with Marhowrah PS case no. 337 of 2016 registered for the offence punishable under Section 395 of Indian Penal Code. The allegation is regarding unknown dacoits having entered the house of the informant and looted away cash and jewellery on gun point.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, inasmuch as neither any recovery has been made from the petitioner nor any test identification parade has been held to connect the petitioner with the alleged crime. It is further submitted that though the petitioner is an accused in one other

Patna High Court Cr.Misc. No.8650 of 2019(2) dt.14-02-2019 2/2 case but he is on bail in the said case. It is further submitted that similarly situated co-accused has already been enlarged on bail vide order dated 23.12.2016 passed in Cr. Misc. no. 667 of 2017. Lastly, it is submitted that the petitioner is languishing in custody since 24.11.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-2, Saran at Chapra in connection with Marhowrah PS case no. 337 of 2016.
