JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 Petitioner seeks bail in connection with Brahmpur (Chakki O.P.) P.S. Case No. 371 of 2019, registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

Prosecution case is of recovery of 77.76 litres of liquor from a tempo and driver was arrested, who disclosed the name of the petitioner who was sitting in tempo. Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he has no criminal antecedent and he is in custody for more than two months and charge sheet has been submitted, as such there is no chance of tampering with the evidence.

Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.5421 of 2020(2) dt.31-01-2020 2/2 petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-II-cum-Special Judge, Excise, Buxar, in connection with Brahmpur (Chakki O.P.) P.S. Case No. 371 of 2019.
