A shocking state of affairs has been brought to the notice of this Court in as much as in contemplation of a departmental proceeding, the petitioner was suspended on 08.07.2015 and Memo of Charge also was served upon him shortly thereafter i.e. on 01.08.2015. However, till date, there has been no progress in the departmental proceeding and it appears that the disciplinary authority has absolutely forgotten that the petitioner has been put under suspension.

Though the learned counsel for the State has sought time to put in his response to the petition, but considering the fact that no progress has taken place in the departmental proceeding, even though the suspension order is of the year 2015 and charges have already been framed, this Court deems it appropriate to direct the concerned respondents to conclude the proceedings as early as possible, preferably within a period of four months from the date of passing of this order/production of a copy of this order to the concerned respondent.

4. If the respondents fail to conclude the proceeding within the aforesaid stipulated time, the suspension of the petitioner shall stand revoked.

5. With the aforesaid direction/observation, the writ petition is disposed of.
