JUSTICE ARVIND SRIVASTAVA ORAL ORDER 25-04-2022 Heard learned counsel for the petitioner, learned A.P.P. for the State as well as learned counsel for the Bank. The petitioner apprehends his arrest in Bihar P.S. Case No.233 of 2020 registered under Sections 406, 409, 420/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that 50% amount of share of the petitioner i.e. Rs.1,66,500/- has already been deposited in Nalanda Central Co-operative Bank, Bihar Sharif as stated in the supplementary affidavit and the petitioner is ready to deposit the rest amount due against him in nine months.

No.17928 of 2021(9) dt.25-04-2022 2/2 In view of the above submissions, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S. Case No.233 of 2020, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
If the petitioner fails to deposit the rest amount of his share within the stipulated period, the bail granted to the petitioner shall automatically be cancelled.
