In this case, the petitioner is apprehending his arrest in connection with Special P.S. Case No. 863 of 2018 arising out of Alamganj P.S. Case No. 47 of 2018 registered for offences under sections 30(a) of the Bihar Excise Act and Section 25(1-b), 26 and 35 of the Arms Act.
As per F.I.R., the police party apprehended the bike and two persons were arrested. From the dicky of the bike, the police recovered 50 liters of Mahua liquor, money amounting Rs. 1,000/- as also 2 live cartridges and 1 dead cartridge. Learned counsel for the petitioner submits that the name of the petitioner has surfaced in this case on the confessional statement of the co-accused persons.
Patna High Court Cr.Misc. No.7444 of 2019(2) dt.08-02-2019 2/2 Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.
If the petitioner surrenders before the court below within a period of three weeks from today and prays for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law.
