The present application under Section 482 of the Code of Criminal Procedure has been preferred for modification of the order dated 12.4.2016 passed in Cr. Misc. No.2383 of 2016 wherein name of petitioner no.1 has been typed as Md. Nasim in place of Md. Hasim.
It is submitted by the learned counsel for the petitioner that due to typographical error in the order dated 23.11.2015 passed by the learned 4th Additional Sessions Judge, Purnea, in ABP No.1386 of 2015 the name of the petitioner no.1, Md. Hasim was typed as Md. Nasim and because of that when the application
Patna High Court Cr.Misc. No.24231 of 2016 (2) dt.20-07-2016 2/2 for bail was filed before this Court, it was filed in the name of Md. Nasim in place of Md. Hasim. Accordingly, while granting bail to the four accused vide order dated 12.4.2016, the name of the petitioner no.1 was typed as Md. Nasim. He has submitted that the error committed in the order of the learned 4th Additional Sessions Judge, Purnea has already been rectified vide order dated 2.5.2016.
Learned counsel for the State does not oppose the prayer for modification of name of the petitioner no.1. In view of the submissions advanced at the Bar, in the order dated 12.4.2016 passed in Cr. Misc. No. 2383 of 2016 in the cause title as also in the last paragraph of the order Md. Nasim be read as Md. Hasim.
Let the order be communicated to the court below forthwith.
In view of the aforesaid modification, time granted to the petitioner to surrender before the court below vide order dated 12.4.2016 is extended by further three weeks. (Ashwani Kumar Singh, J) Md.S./- U T
