Patna High Court CR. MISC. No.10380 of 2019(3) dt.10-05-2019 2/3 The petitioners apprehend their arrest in connection with Dumraon P.S. Case No.16 of 2018 registered under Sections 147, 148, 149, 504, 323, 333, 136, 325, 326, 307, 427, 337, 338, 353, 290 and 120(B) of the Indian Penal Code besides Section 3 of the Damage to the Public Property Act. The accusation is that the informant being the Sub Divisional Officer, Dumraon, was on duty on 12.01.2018 to maintain the law and order in the programme of 'Samiksha Programme" of the Chief Minister in Nandangaon.
In course of returning of the Chief Minister from Nandangaon after supervising the work, when the carcade reached at Teemmohani of the village, the ante elements including men, women and children started raising slogan in filthy language and pelting stones in which some vehicles became damaged. Anyhow, the Administrative Officer and police personnel tried to control the situation. At that time, four persons, namely, Ramu Yadav, Dharmendra Yadav, Jiut Kumar and Rajkumar alias Bhola, were apprehended. At that time, the local chowkidar, villagers and spy disclosed the name of 99 persons including the petitioners.

Further submission is that similarly situated co-accused Amod Kumar and 8 others have already been granted the privilege of pre-arrest bail by a Bench of this Court vide order dated 17.04.2019 passed in Criminal Misc. No.7643 of 2019. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Dumraon P.S. Case No.16 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U
