The petitioner seeks bail in a case for the offence punishable under section 366 A/34 of the I.P.C Allegedly, the petitioner and other FIR named accused persons kidnapped Farjana Khatoon, the daughter of the informant, and during investigation the victim girl appeared and her statement has been recorded under section 164 Cr. P.C. wherein she has stated regarding kidnapping by the petitioner but has not stated regarding any sexual assault committed upon her by the petitioner or any one.
In the facts and circumstances as stated above, the petitioner, who is in custody since 20.02.2015, is directed to be

No.43939 of 2015 (3) dt.13-01-2016 2/2 released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Saharsa in Bakhtiyarpur P.S. Case No. 31 of 2010, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
