JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-03-2022 Heard Mr. Sanjay Kumar Sharma, learned Advocate for the petitioner and Mr. Birendra Narayan Sharma for the Informant. The State is represented by learned A.P.P. The petitioner seeks bail in anticipation of his arrest in connection with Bikramganj P.S. Case No. 151 of 2020 dated 21.04.2020 instituted for the offences under Sections 366(A) of the Indian Penal Code.

The accusation against the petitioner and his family members is of having abducted the 16 years old daughter of the Informant.

The learned counsel for the petitioner submits that accusation is absolutely false. The so-called victim girl has been recovered, whose age has been medically assessed to be

She has given her statement before the police that she had gone along with the petitioner of her own volition because she had developed a relationship with him. The Informant is also said to have told the investigating agency that the accusation of kidnapping is not correct.

Considering the facts aforesaid, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas in connection with Bikramganj P.S. Case No. 151 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
