====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 29-08-2016 Heard the learned counsel, Mr. Ashok Kumar Jha, for the petitioner.
Perused the order dated 20.07.2016 passed by District Judge, Sheohar whereby the application filed by the petitioner under Section 24 of the Code of Civil Procedure has been rejected. It appears that respondent in Title Appeal who are the petitioners herein filed application under Section 24 of the Code of Civil Procedure praying for transfer of Title Appeal No.6 of 2005 from the Court of ADJ-I, Sheohar to any other competent Court. The District Judge called for report from the ADJ-I and after perusal of the record and after perusing the orders passed by the High Court clearly recorded that this application has been filed by the petitioner only with a view to delay the disposal of the old cases.
In such view of the matter, I find no jurisdictional
Patna High Court C.Misc. No.698 of 2016 (2) dt.29-08-2016 2/2 error in the impugned order so as to call for an interference in exercise of supervisory jurisdiction.
