2. The petitioner seeks bail in connection with Aurangabad Mahila P.S. Case No. 63 of 2023 registered for the offence under Sections 376, 504, 506, 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner had sexual relation with the victim on the promise of marriage.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 10.12.2023. It has been submitted by the learned counsel for the petitioner that the petitioner and the victim had got married.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.8877 of 2024(2) dt.22-02-2024 2/2 prayer for bail.

6. Considering the aforesaid fact, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, VI-Cum-Exclusive Special Judge, POCSO Act, Aurangabad in connection with Aurangabad Mahila P.S. Case No. 63 of 2023.

8. At the time of furnishing bail bond, the Special Judge will verify the fact of marriage from the victim. If the victim support the factum of marriage with the petitioner, the bail bond of the petitioner shall be accepted otherwise the petitioner shall not be released on bail.
