The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Nepali liquor was recovered from near a motorcycle lying on the bank of canal.

Submission is that neither the motorcycle nor the liquor was of the petitioner. Petitioner has got no criminal antecedent. Only on the statement of some person before the police petitioner has been arrayed as accused in this case. Case No. 152 of 2018, corresponding to G.R. No. 1404 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
