JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is languishing in jail custody since 3110-2012 in a case, in which, charge has been framed against him u/S 304B/34 of the Indian Penal Code.
Earlier prayer for bail of the petitioner was rejected by this court with direction to the trial court to conclude the trial of the petitioner within 9 months but it appears that still the trial of the petitioner is pending for recording the evidence of the doctor and the investigating officer.
In the aforesaid circumstance, this petition stands rejected with direction to the trial court to conclude the trial of the
Patna High Court Cr.Misc. No.41916 of 2015 (2) dt.02-12-2015 2/2 petitioner within two months from the date of receipt/production of copy of this order, failing which, petitioner shall be entitled to renew his prayer for bail before the trial court itself. The copy of this order be communicated to the Superintendent of Police, Purnea with direction to him to ensure the presence of doctor and the I.O. of K. Nagar ( Champa Nagar) P.S. Case No. 304 of 2010 corresponding to Sessions Trial No. 313 of 2013/ 1795 of 2015 within a month from the date of receipt/production of copy of this order before the learned Additional District & Sessions Judge-III, Purnea.
