====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 29-09-2016 Heard the learned counsel, Mr. Arun Kumar Prasad, for the petitioner.

Perused the impugned order dated 19.03.2016 passed by Sub Judge IX, Chapra in Title Suit No.402 of 2000 whereby the Court below rejected the application filed by the petitioner for analogous hearing of the suit with Title Suit No.641 of 2015 filed by the present petitioner.

Admittedly, the Title Suit filed by the respondent is of the year 2000 and it is running for argument. The suit of the petitioner is of the year 2015 and still issues have not been framed in the suit. Therefore, there is no question of analogous hearing of both the cases. The Court below, therefore, considering all these aspects matter has rightly rejected the application filed by the petitioner.

Thus, it is not a case for interference in exercise of

Patna High Court C.Misc. No.763 of 2016 (2) dt.29-09-2016 2/2 supervisory jurisdiction under Article 227 of the Constitution of India.

Accordingly, this Civil Misc.

application is dismissed.
