JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-04-2019 This is an application for grant of anticipatory bail in connection with Mahila P.S. Case No. 44 of 2018, disclosing offences under Sections 341, 323, 354(B), 494, 498(A), 504, 506, 34of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Allegation against the petitioner, who happens to be the father-in-law of the informant, is of making illicit advance against the informant and she further alleged that her husband has illicit relationship with another girl.

Submission of learned counsel for the petitioner is that present case is counter blast case of earlier case lodged by the son of the petitioner against the informant and others, which is Annexure-4.

Patna High Court CR. MISC. No.7138 of 2019(4) dt.05-04-2019 2/2 Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Purnea, in connection with Mahila P.S. Case No. 44 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
