JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-07-2021 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioner and the learned A.P.P. for the State, Sri Ashok Kumar.

The present petition has been filed seeking

2/3 modification of the order dated 11.06.2020 passed in Criminal Miscellaneous No. 10870 of 2020 to the extent that the time granted to the petitioner to surrender before the learned court below be extended by a further period of four weeks.

The learned counsel for the petitioner has submitted that on account of the prevailing Covid19 pandemic situation and due to non-functioning of the learned court below, the petitioner could not surrender within the time fixed by this Court, hence, he seeks extension of time granted for the purposes of surrendering and being admitted to the privilege of anticipatory bail.

The learned APP for the State, Sri Ashok Kumar, has got no objection.

Having regard to the facts and circumstances of the case and considering the submissions advanced by the learned counsel for the parties, four weeks' further time is granted to the petitioner to surrender before the learned court of

3/3 Special Judge Excise Patna in connection with Spl. Case No. 5760 of 2019 arising out of Bhagwanganj P.S. Case No. 61 of 2019, in order to avail the privilege of anticipatory bail.

The present petition stands disposed of with the aforesaid modification in the order dated 11.06.2020 passed in Criminal Miscellaneous No. 10870 of 2020.
