JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report and it is alleged that petitioners and several other accused made indiscriminate firing as a result of which, one girl died having sustained fire-arm injury.
Learned counsel for the petitioners submits that according to prosecution case itself, petitioners were not armed with fire-arms rather petitioner No. 1 was carrying bow and arrow whereas; petitioner No. 2 was carrying sword in their hands at the time of alleged occurrence. It is further contended by him that having more or less similar allegation, some co-accused have

From perusal of paragraph-75 of the case diary, I find that only one injury, said to be caused by fire-arm, was found on the person of the deceased. There was land dispute between the parties and they were on litigating terms, since long. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Raniganj P.S. Case No. 281 of 2014 to the satisfaction of Sri Sanjay Singh, J.M.-Ist Class, Araria. (Hemant Kumar Srivastava, J) A.K.V./- U T
