Earlier prayer for anticipatory bail of the petitioner was rejected by this court vide order dated 10-08-2017 passed in Cr. Misc. No. 36946 of 2017 by speaking order.

Counsel for the petitioner has renewed his prayer for anticipatory bail only on the ground that subsequent to this order, other accused persons have been granted anticipatory bail by this court. Counsel for the petitioner has submitted that he has passed the examination of Bihar School Examination Board, 2006 and has not enclosed Madhyama mark sheet.

The copies of order have been annexed as Annexure-4 series from which, it appears that all those orders have been passed with reference to different cases and not with regard to R.C. 03(A)/13 in which, the petitioner is an accused.

Patna High Court Cr.Misc. No.3348 of 2018 (2) dt.31-01-2018 Therefore, this court does not find any fresh material to reconsider the prayer for anticipatory bail of the petitioner. As such, prayer for anticipatory bail of the petitioner is rejected.

The petitioner is directed to surrender in the court below and seek regular bail which will be considered and disposed of by the court below on its own merit in accordance with law without being prejudiced by this order taking into account the submission made by the petitioner in this case.
