The petitioner seeks bail in connection with Kathaiya P. S. Case No. 121 of 2019 dated 30.07.2019, instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The petitioner is stated to be in custody since

Patna High Court CR. MISC. No.7586 of 2020(3) dt.28-05-2020 2/3 19.12.2019 and is an accused in one more case of similar nature about which reference has been made in paragraph 3 of the bail petition.

It appears that a truck was intercepted on suspicion that it is loaded with incriminating substance. Two of the persons managed to run away. The driver of the vehicle who also tried to flee away was arrested, who has disclosed the name of the petitioner.

Learned counsel for the petitioner has submitted that though there is recovery of 4763.700 litres of liquor which was brought in the State of Bihar from Haryana but the name of the petitioner has only transpired on the statement of the arrested driver of the vehicle, namely, Salman Khan.

Regard being had to the nature of accusation and the period of custody, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction
