JUSTICE AMARESH KUMAR LAL ORAL ORDER 06-02-2015 Both these cases arise out of Parihar P.S. Case No. 76 of 2014, as such, they have been heard together and are being disposed of by this common order.
The petitioners seek bail in a case registered for offence
Patna High Court Cr.Misc. No.39726 of 2014 (3) dt.06-02-2015 2/3 punishable under Section 394 of the Indian Penal Code. The allegation is that Mukesh Kumar and three unknown persons dragged the informant on the point of country made pistol and looted articles and snatched Rs. 600 with a mobile Sim. During investigation, a looted mobile has been recovered from the possession of Mukesh Kumar. The name of the other petitioner Suresh Chaurasia has appeared in the confession of Rambali Rai and nothing has been recovered from possession of Suresh Chourasia. Stolen mobile sim has been recovered from possession of Mukesh Kumar. Considering the facts and circumstances, the above named petitioners, Suresh Chaurasia and Mukesh Kumar Rai @ Mukesh Rai @ Mukesh Kumar are directed to be released on bail on furnishing bail bonds of Rs.
10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sidtamarhi/ court concerned in connection with Parihar P.S.Case No. 76 of 2014 after framing of charge with following conditions:- I) One of the bailors will be the close relative of the petitioners.
II) The petitioners will not indulge in similar or

III) The petitioners will be well represented in the Court.
IV) In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the Court concerned.
