JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-03-2022 Heard Mr. Nilendu Kumar Choudhary, learned advocate for the petitioner and Md. Aslam Ansari for the State. The petitioner seeks bail in anticipation of his arrest in connection with Bahera P.S. Case No. 139 of 2020 dated 11.04.2020 instituted for the offences under Sections 341, 323, 307, 447 and 34 of the Indian Penal Code.
The informant is said to have been assaulted by one one Krishna Choudhary whereafter the petitioner and one Sagar Choudhary are said to have hit him by the back portion of the axe.
The nature of injury suffered by the victim has not been assessed for want of further medical investigation. It has further been submitted that from the accusation itself, it would appear that there was no intention to cause any life threatening

There is a dispute with respect to reaping the standing crops in the field over which there are rival claims. The petitioner does not have criminal antecedent. Considering the facts aforesaid, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with Baherea P.S. Case No. 139 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
