Patna High Court CWJC No.24833 of 2013 (2) dt.06-12-2017 3/3 06-12-2017 Heard learned counsel for the petitioner as well as the respondents.
2. It has been submitted that the present application has been filed to quash the order dated 19.09.2013 passed by Sub Jude-IV, Gopalganj whereby and whereunder the report of Advocate Commissioner was rejected and the court below appointed another Advocate Commissioner. The second Advocate Commissioner has submitted a report and his report was challenged by the petitioner before the court below. The court below rejected the petition on 20.12.2016. The respondent filed Civil Miscellaneous Case No.1419 of 2016 against the said order which after hearing was dismissed and against that order, the respondents moved the Hon'ble Apex Court and the matter is still pending.
3. In the facts and circumstances, the petitioner does not want to press this application. Accordingly, this application is disposed of.
