The petitioner seeks regular bail in connection with Nawada (Town) PS case no. 859 of 2018 registered for the offence punishable under Section 307/34 of Indian Penal Code. The allegation is regarding the petitioner herein having assaulted the informant on his head by a knife while they were sitting in an auto-rickshaw. Subsequently, the auto-rickshaw was apprehended by the police and the petitioner was taken into custody.
It is submitted by the learned counsel for the petitioner that the petitioner has been falsely implicated in the present case, the injury suffered by the informant is simple in
Patna High Court Cr.Misc. No.8643 of 2019(2) dt.14-02-2019 2/2 nature and though the petitioner is an accused in one other case but he is on bail in the said case. It is further submitted that the petitioner is languishing in custody since 24.11.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Nawada in connection with Nawada (Town) PS case no. 859 of 2018. (Mohit Kumar Shah, J) rinkee/- U T
