Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Ghorasahan P.S. Case No.108 of 2020, registered for the offences punishable under Sections 3/4 of the Explosive Substances Act.

Co-accused had committed bomb blast and thereafter allegation is that explosives was recovered from the house of the petitioner. Petitioner is cousin brother of co-accused. The petitioner has got criminal antecedent.

Considering the aforesaid fact, in my view, this is not

Patna High Court CR. MISC. No.17711 of 2021(2) dt.24-11-2021 2/2 a fit case for grant of anticipatory bail. Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner within two weeks, the prayer for regular bail shall be considered without being prejudiced by the order of this Court considering the fact that it was a case of simple kidnapping and no other allegation is there.
