JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-03-2022 Heard Mr. Satish Kumar Singh, learned Advocate for the petitioner and Mr. Anil Kumar for the State. The petitioner seeks bail in anticipation of his arrest in connection with Begusarai Mufassil (Singhaul OP) P.S. Case No. 441 of 2020 dated 02.09.2020 which was initially instituted for the offences under Sections 363/365 of the Indian Penal Code but, subsequently Sections 302/201/34 of the Indian Penal Code have been added.

According to the prosecution case, the wife of the deceased had alleged that her husband left the house with one Ashok Pandit, never to return. Later on, his dead body was recovered.

The petitioner happens to be the father of the aforesaid Ashok Pandit. Ashok Pandit is stated to have been granted regular bail by this Court.

Patna High Court CR. MISC. No.18907 of 2021(4) dt.11-03-2022 2/2 The implication of the petitioner in the instant case is on the basis of confession made by Ashok Pandit (son of the petitioner) while in police custody.

The learned counsel for the petitioner has submitted that the accusation is directed only towards the son of the petitioner and that also on the principle of last seen. No specific evidence could be collected against the petitioner for his having taken part in the occurrence or of conspiring to commit murder of the husband of the Informant.

Regard being had to the aforestated facts, the petitioner directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Mufassil (Singhaul) P.S. Case No. 441 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) rishi/- U T
