JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Sessions Trial No. 06 of 2020 arising out of Tankupaa P.S. Case No. 87 of 2019 registered for the offence punishable under Sections302, 201/34 of the Indian Penal Code. Petitioner is not named in the F.I.R., it is alleged that they have taken the deceased. Later on, dead body of the deceased were shown lying under Pathar, Tankuppa Police station.

Submission of the learned counsel for the petitioner is that except that they have taken the deceased person with them, nothing has been against them and other accused person has already been granted bail vide order dated 04.02.2020 passed in Cr. Misc. No. 2549 of 2020. Petitioner is in custody since 03.10.2019. Charge-sheet has already been submitted, there is

Heard learned A.P.P. as well as learned counsel for the informant who have opposed the prayer for bail on the ground that learned Sessions Judge shows that he has admitted on confessional statement, there is no recovery of dead body rather bottles and some other articles and there are CDR is recovered. Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.D.J.-XII, Gaya, in connection with Sessions Trial No. 06 of 2020 arising out of Tankupaa P.S. Case No. 87 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
