This application for regular bail arises out of Rajauli P.S. Case No. 336 of 2019, disclosing offences punishable under Sections 392 of the Indian Penal Code and later on converted under Section 395 of the Indian Penal Code.
The driver of the truck is the informant. Allegedly, the truck which was loaded with stone ships was looted by the unknown miscreants.
During the course of investigation, the police were able to apprehend one of the miscreants as mentioned in the
Patna High Court CR. MISC. No.9257 of 2020(3) dt.01-06-2020 2/3 case diary, who is said to have made a confessional statement disclosing names of other persons including the petitioner's name who were involved in commission of offence. This is how the petitioner's name has emerged in connection with the case. Learned counsel appearing on behalf of the petitioner has submitted that he is in custody since 07.10.2019, and despite that, he has, at no point of time been put on T.I. Parade. She has further submitted that except for the confessional statement of the persons whose names have emerged in course of investigation, including that of the petitioner, there is absolutely no material worth evidence to establish the prosecutions case against the petitioner.
She has further contended that similarly circumstanced persons have been allowed regular bail by this Court by orders dated 03.02.2020 passed in Cr. Misc. No. 7655 of 2020 and 02.03.2020 passed in Cr. Misc. No.10181 of 2020. Considering the submissions made on behalf of the petitioner that similarly circumstanced co-accused persons have been allowed regular bail by this Court, this application is allowed.
Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned
Patna High Court CR. MISC. No.9257 of 2020(3) dt.01-06-2020 3/3 C.J.M., Nawada in connection with Rajauli P.S. Case No. 336 of 2019.
