2. The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a) and 41(1) of Bihar Prohibition and Excise Act.

3. As per F.I.R., 13.5 liters of illicit liquor has been recovered from a motorcycle and petitioner is alleged to be pillion rider of said motorcycle, who fled away after seeing the police team.

4. It is submitted on behalf of petitioner that no article has been recovered from conscious possession of petitioner and has been implicated in this case only on suspicion. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

Considering the quantity of recovery and clean antecedent, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No. 1, East Champaran, Motihari in connection with Malahi P.S. Case No. 42/2024, subject to condition as laid down under Section 482 of the B.N.S.S., 2023.
