Petitioner is not named in the first information report and for the first time, name of the petitioner appeared in this case on 5.6.2014 in the statement of Ravindra Yadav which has been incorporated by the Investigating officer at para 8 of the supplementary case diary.

Moreover, Investigating officer has incorporated at para 8 of the supplementary case diary that he came to know about involvement of the petitioner in this crime from villagers. Subsequently, some witnesses stated that the petitioner committed murder of the deceased as deceased had illicit relation with daughter of the petitioner. Taking note of the aforesaid facts and circumstances as well as submissions of the parties, particularly, keeping in mind that name of the petitioner came in this case after seven months of alleged
