The petitioner has filed this civil miscellaneous petition against the order dated 20.11.2017, passed by the learned Principal Judge, Family Court, Buxar in Matrimonial Case No.32 of 2015 by which the learned Principal Judge, Family Court, Buxar directed the petitioner to pay Rs.3000/- per month to his wife and Rs.1000/- per month to his minor child as maintenance.
3. The learned counsel for the petitioner submits that the petitioner is ready to keep his wife. Petitioner filed a petition for restitution of conjugal rights but without taking into consideration the fact, the learned Principal Judge has directed the petitioner to pay maintenance to his wife. It appears that the wife has stated that she had time and again gone to the house of her husband, her
Patna High Court C.Misc. No.507 of 2018 dt.25-08-2018 2/2 husband is a drunkard and he used to assault her and drive her out from the house. The learned Principal Judge after taking into consideration the facts directed the petitioner to pay a sum of Rs.3000/- per month for interim maintenance to his wife and Rs.1000/- for maintenance of the son of the petitioner.
4. Considering the facts, I do not find any illegality in the order dated 20.11.2017. Accordingly, the civil miscellaneous petition is dismissed.
