I.A. No.01 of 2025

2. Learned Counsel for the petitioners submits that the present I.A. No.01 of 2025 has been filed for amendment in the prayer portion of the writ petition for directing the respondents authorities to regularize the petitioners on the basis of which they worked as daily wager for more than 240 days and further direction to absorb them on the post under Advertisement

4/5 contained in Memo No.1555 dated 31.03.2023 on the ground that they had worked continuously as daily wages for more than 10 years.

3. Learned Counsel for the BSSC submits that the present writ petition was initially filed for granting permission to participate in the counseling pursuant to penal list prepared for appointment to the post of Group IV vide Advertisement No.1555 dated 31.03.2023.

4. Counsel submits that the further prayer has been made that the counseling, which was going to be held on 28.01.2025, was requested to be stayed till final adjudication of the writ petition. He further submits that the said period has already lapsed and appointment process has already completed. Thereafter, the petitioners have filed the present I.A. for regularization of the service of the petitioners.

It transpires to this Court that in the entire pleading, the case of the petitioners has been described otherwise, but by way of present I.A., the petitioners want to develop a new relief, is not sustainable in the eye of law. At this juncture, the said I.A. cannot be allowed and hence, the present I.A. No.01 of 2025 is hereby dismissed.

6. So far as the present writ petition is concerned, this Court finds that the Advertisement No.1555 dated 31.03.2023 has already been ended and selection has been made, therefore, the present writ petition has become infructuous.

7. However, liberty is hereby granted to the petitioners with regard to the prayers made in the I.A. No.01 of 2025, if so advised, they may challenge the same by way of filing a fresh writ petition.

8. With the aforesaid directions and observations, the present writ application stands dismissed.
