Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-01-2022 Heard Mr. Anil Kumar Saxena, learned Advocate for the petitioners and the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Paraiya P.S. Case No. 63 of 2020 dated 16.04.2020 instituted for the offences under Sections 341, 323, 504, 308, 325 and 34 of the Indian Penal Code.

It has been urged on behalf of the petitioners that though they are said to have assaulted the informant and his mother respectively, but the injuries suffered by both of them are reported to be simple in nature. The injury on the person of the informant is but on a vital portion of his body viz. head.

No.17994 of 2021(2) dt.10-01-2022 2/2 Be that as it may, learned counsel for the petitioners has drawn the attention of this Court to the fact that petitioner no. 2 has also lodged FIR vide Paraiya P.S. Case No. 64 of 2020 against the informant of the present case and his other associates. The learned counsel for the petitioners has submitted that because of an earlier dispute, a false case accusation has been made against the petitioners. Regard being had to the background facts, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Gaya in connection with Paraiya P.S. Case No. 63 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
