The petitioner is languishing in custody since 12.07.2018 in a case registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act. It is alleged that on a secret information, the Officer I/c Shambhuganj Police Station on 10.07.2018 laid a raid on the house of co-accused Pankaj Yadav and the petitioner, Manoj Yadav and from the possession of co-accused Pankaj Yadav, one gun loaded with two cartridges therein along with 18 cartridges whereas from the possession of the petitioner, one gun loaded with two cartridges were recovered. It is submitted by learned counsel for the petitioner that though during investigation, it transpired that the
Patna High Court Cr.Misc. No.10641 of 2019(2) dt.22-02-2019 2/2 petitioner is accused in one other case, but in fact, the petitioner is not accused in that case. It is further submitted that the investigation has already been concluded. Learned APP for the State submits that the said recovery has been made from the house of the petitioner. Considering the quantity of recovery and the period under custody, coupled with the fact that the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Banka in connection with Shambhuganj P.S.
