This application for grant of regular bail arises out of Bibhutipur P.S. Case No.40 of 2022 registered for the offence under Sections 30(a), 32(ii),(iii),36/41(i)(ii) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

There is recovery of 2525 litres of foreign liquor from Mini truck, Bolero pick up van and Tata Magic van. The petitioner is said to be the driver of Bolero pick up van. The petitioner is in custody since 06.12.2022.

Considering the period of custody and also the fact that the petitioner has clean antecedent, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with

Patna High Court CR. MISC. No.8196 of 2023(2) dt.03-05-2023 2/2 two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Court-I, Samastipur, in connection with Bibhutipur P.S. Case No. 40 of 2022 (Excise G.R. No.111 of 2022).
