JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-04-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Dariyapur P.S. Case No. 551 of 2021, registered for the offence punishable punishable under Section 30, 30(a), 33 of the Bihar Prohibition and Excise Act, 2016.

Total 150 litres of illicit liquor has been recovered from two motorcycles and near Bhatti and four persons including this petitioner were apprehended on the spot. It is submitted that no recovery has been made from conscious possession of this petitioner and has got no concern with the seized liquor. Petitioner is in custody since 08.11.2021 having no criminal antecedent, as stated in para 3 of the petition. Investigation is complete.
