This application for anticipatory bail arises out of Khutauna P.S. Case No. 78 of 2018 for the offence under Sections 342, 323, 307 and 498(A)/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner has submitted that sister of the husband of the informant, against whom similar allegation has been made, has been granted anticipatory bail by this Court by an order dated 21.12.2018 passed in Cr. Misc. No. 74781 of 2018. The petitioner is mother-in-law of the informant and on perusal of the First Information Report, it transpires that the allegation against the petitioner and that of Madhu Devi is almost identical.

Let the petitioner above named, in the event of her arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Jhanjharpur, Madhubani, in Khutauna P.S. Case No. 78 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
