2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 308(4), 118(1)(2), 109, 351(2)(3) and 3(5) of the B.N.S. and Section 27 of the Arms Act.
3. As per prosecution case, informant, namely Raju Ranjan Choudhary, alleged that on 15.05.2024, his father, namely Ram Dayal Chaudhary, was shot by two unknown assailants at his tobacco kiosk. It is alleged that on 08.10.2024, his father had received a threat call demanding Rs. 5,00,000/-

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R.. Name of petitioner transpired during course of investigation, on the basis of confessional statement of co-accused who is none else than brother of this petitioner. It is further submitted the save and except confessional statement, there is no material on record to show the complicity of this petitioner in the alleged occurrence. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that during course of investigation, the victim has stated that he has seen the assailants and both of them were talking to each other and revealed their names as Raushan Kumar and Rohit Kumar. It is further submitted that Raushan Kumar has admitted that his brother, i.e. this petitioner, used to commit crime by the mobile phone. The said mobile phone was eventually recovered from another co-accused person.
6. Considering the nature of accusation and material
