====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-02-2026 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioners apprehend their arrest in a case registered for the offence under Sections 115(2), 109, 303(2), 76, 352, 351(2), 3(5) of the B.N.S., 2023.
3. As per F.I.R., on 01.07.2025, all the named accused persons including these petitioners assaulted informant, his father and other family members, causing injuries to them.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.8026 of 2026(2) dt.20-02-2026 2/3 from bare perusal of the F.I.R., it is apparent that specific allegation of inflicting knife to informant's father is against coaccused Md. Hakim. So far as these petitioners are concerned, there is general and omnibus allegation. Case and counter case. Petitioners claim clean antecedent.
5. Learned counsel for the informant vehemently opposes the prayer for anticipatory bail and submits that there is specific allegation against petitioner no. 3 (Md. Alam) of causing assault with iron rod to informant.
6. Considering the fact that there is specific accusation of assault with iron rod against petitioner no.3 (Md. Alam), his prayer for anticipatory bail is rejected.
7. So far as rest petitioners are concerned, there is general & omnibus allegation and no specific role has been assigned to them, in the event of their arrest/surrender within a period of eight weeks from today, let the petitioner nos. 1, 2, 4 & 5, as named above, be enlarged on bail on furnishing bailbonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Jhanjharpur, District - Madhubani in connection with Madhepur P.S. Case No. 96 of 2025, corresponding to G.R. No. 1312 of 2025, subject to condition as
Patna High Court CR. MISC. No.8026 of 2026(2) dt.20-02-2026 3/3 laid down under Section 438(2) of the Code of Criminal Procedure.
