Heard the learned counsel for the petitioners and learned counsel for the informant.

Patna High Court CR. MISC. No.6741 of 2022(2) dt.25-08-2022 2/3 The petitioners apprehend their arrest for the offences alleged under Sections 341, 342, 365, 323, 324, 307 and 325/34 of the Indian Penal Code, registered in connection with Mahnar P.S.Case No. 277 of 2021.

As per allegation, the accused persons forcibly got the informant seated in their vehicle. They badly assaulted him and after throwing him they fled away.

The learned counsel for the petitioners has submitted that three days prior to lodging of the FIR, the father of the petitioner Santosh Singh had sent a letter to the Superintendent of Police with allegation that the informant made vulgar videos of his daughter and post the same on social media. No action was taken by the Superintendent of Police and in the meanwhile this false case has been lodged. The father of the petitioner Santosh Singh has also lodged an FIR being Jandaha P.S.Case No. 207 of 2021 against the informant with the allegation that he after making vulgar videos post the same on social media. He has further submitted that the petitioner Shivam Kumar Singh is the brother-in-law of the sister of petitioner Santosh Singh. On the other hand, learned counsel for the informant has opposed the prayer for anticipatory bail and submitted that the informant has sustained grievous injury

Considering the above facts and circumstances, let the petitioners of both the case above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahnar P.S.Case No. 277 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
