2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 85, 108 and 3(5) of BNS.

3. The case of the prosecution is that the deceased was married to this petitioner fifteen years ago. It is alleged that she was subjected to cruelty on account of non-fulfillment of dowry demand. On 14.10.2024, the informant was informed that his daughter along with her child aged about one and half years were found dead in Nagi Dam.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned

Learned counsel has submitted that actually the deceased has gone with the child and has committed suicide by jumping in Nadi Dam. He has further submitted that as the marriage was solemnized fifteen years ago, the allegation under Section 80 of BNS is not attracted. At most, it is a case of abetment of suicide. He has further submitted that there is no material against the petitioner to show that he has abetted the deceased to commit suicide. It is not normal that a father would allow his child to die. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 14.10.2024.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jhajha P.S. Case No. 464 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Principal District and
