This application for grant of anticipatory bail arises out of G. O. Case No. 02 of 2007, disclosing offence under Section 27 (a) of the Drugs and Cosmetics Act, 1940. It is evident that the case was registered in the year 2007. The petitioner had earlier approached learned Sessions Judge, Samastipur, for grant of anticipatory bail in the year 2007 itself. The application was rejected. He filed second application for grant of anticipatory bail nearly 11 years thereafter before the Sessions Judge for grant of anticipatory bail, which has been rejected.

I am not inclined to entertain this application for

Patna High Court Cr.Misc. No.8748 of 2019(2) dt.14-02-2019 2/2 anticipatory bail 12 years after lodging of the complaint case. This application is, accordingly, dismissed.

The petitioner is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
