The petitioner wants to renew his prayer for bail which was earlier thrice rejected by this Court by order dated 03.05.2012, 06.03.2013 and 06.08.2014 vide Cr. Misc. Nos. 10550 of 2012, 3940 of 2013 and 3394 of 2014 on the ground that inspite of direction of this Court the trial has not been concluded and the petitioner is suffering in custody since 30.09.2011. The learned A.P.P. opposes prayer for bail by submitting that from the report of the learned trial judge it is evident that the case is pending for defence evidence and it is the fault of the petitioner in not producing the defence witness. No.50207 of 2015 (3) dt.04-01-2016 2/2 no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with Sessions Trial No. 365 of 2012/ 131 of 2012 arising out of Kako (Bhelawar) P.S. Case No. 136 of 2011 pending in the court of the Additional District & Sessions Judge-II, Jehanabad. However, the trial court is directed to conclude the trial preferably within four months after taking all positive steps and if possible to keep the same on day to day basis.
