The petitioner is in custody in connection with Salkhua P.S. Case No. 100 of 2018 for the offences under Sections 395 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 06.09.2018. He further submits that petitioner was not named in the F.I.R. his name surfaced subsequently he has not been put on TIP and similarly circumstanced co-accused namely Pramod Yadav and Bandar Yadav have been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 71563 of 2018 and Cr. Misc. No. 76318 of 2018 vide orders dated 10.12.2018 and 18.12.2018 respectively.
Patna High Court Cr.Misc. No.8476 of 2019(2) dt.13-02-2019 2/2 Considering the fact that he was not named in the F.I.R. and similarly circumstanced co-accused have been granted bail by co-ordinate Bench of this Court, the Court is inclined to grant bail to the petitioner, let the petitioner named above be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Saharsa in connection with Salkhua P.S. Case No. 100 of 2018.
