1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for offence under Sections 191(1), 192(2), 190, 126(2), 115(2), 74, 303(2), 324(4), 109, 352, 351(2) and 329(4) of the B.N.S., 2023 and subsequently Section 103(1) of BNS was added.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 02.01.2026. It is next submitted that in sum and substance the allegation in the FIR is that in the marriage ceremony, the named accused persons including the petitioner entered the house of the informant and started brutally assaulting the side of the informant and destroyed all articles which were kept for marriage purposes worth Rs. 2,50,000/-, later on account of

Patna High Court CR. MISC. No.6742 of 2026(3) dt.11-05-2026 2/3 assault, Sonu Kumar succumbed to his injuries.

Learned counsel for the petitioner submits that Sonu Kumar and Vidha Mahto @ Vidhyanand had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 70681 of 2025 and the same came to be allowed by an order dated 27.11.2025 passed by a learned Coordinate Bench, further Sanjeev Kumar had also approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 74962 of 2025 and the same came to be allowed by an order dated 26.11.2025 passed by a learned Co-ordinate Bench. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against the petitioner. It is also submitted that if privilege of bail is granted, the petitioner will not abscond rather will cooperate in the trial to prove his innocence.

5. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where

7. One of the bailors of the petitioner shall be his father namely Upendra Mehta @ Upendra Kumar.

8. It is made clear that if the learned Trial Court comes to a conclusion that petitioner, after his release, is trying to delay the framing of charge or after framing of charge is trying to delay the trial, in both the conditions, the learned Trial Court shall be at liberty to cancel the bail bonds of the petitioner.

9. Accordingly, the instant bail application stands allowed.
