JUSTICE RAVI RANJAN ORAL ORDER 11-07-2016 Learned counsel for the petitioners seeks leave to withdraw this application so far as the petitioner nos. 1, 2 and 3 are concerned to surrender and seek regular bail before the court below.

Accordingly, this application is dismissed as withdrawn with the aforesaid liberty with respect to petitioner nos. 1, 2 and 3. It is made clear that in case they surrender and seek regular bail, let the court below consider the same without being prejudiced by the present order and take a decision preferably on the same day.

Patna High Court Cr.Misc. No.26354 of 2016 (2) dt.11-07-2016 2/2 The petitioner nos.4 and 5 apprehend their arrest in a case registered for the offence punishable under Sections 323, 354(B)/34 of the Indian Penal Code and Section 3⁄4 of Dyne Act. It is contended on behalf of petitioner nos. 4 and 5 that they are ladies and it is surprising as to how the allegation under Section 354 (B) of the Indian Penal Code has been made out against them.

Having regard to the facts and circumstances of the case and also the fact that the petitioner nos. 4 and 5 are ladies, let them be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Mahila P.S. Case No.21 of 2016, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Sri Jyoti Prakash, Sub-Divisional Juridical Magistrate, Jehanabad subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
