The petitioner seeks bail in a case under Section 414 of the Indian Penal Code, section 25 (1-b) a, 26 of the Arms Act and under section 17 of C.L.A. Act.

One loaded country made pistol was recovered from the possession of the petitioner and for that the petitioner is in jail since 03.03.2015.

It is submitted that nothing has been recovered from the possession of the petitioner. No recovered arms or ammunition was produced in the court. The petitioner has falsely been implicated in the case.

Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.41989 of 2015 (2) dt.15-09-2015 2/2 allegation made against the petitioner and the fact that petitioner has already remained in jail for more than six months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sikrahana at Motihari, East Champaran in Madhuban P.S. Case No. 47/2015.
