This application for grant of anticipatory bail arises out of Jokihat (Mahalgaon) Police Station Case No. 376 of 2017, disclosing offence under Sections 395, 397 and 402 of the Indian Penal Code and Section 27 of the Arms Act. Learned Counsel appearing on behalf of the petitioner has submitted that his name has cropped up in course of investigation on the basis of unsubstantiated materials. Considering the seriousness of the offence and the fact that the petitioner's custodial interrogation may be required, I am not inclined to allow the petitioner the privilege of anticipatory bail.

The petitioner is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
